CFPB Takes Action Against Property Developers for Marketing Violations

Bureau Orders Developer and Individuals to Repair Roads

WASHINGTON, D.C. — Today the Consumer Financial Protection Bureau (CFPB) took action against a land-development company, International Land Consultants, Inc., and several individuals involved in a Tennessee property development known as Hawks Bluff. The CFPB has ordered the respondents to make repairs to roads in the development.

International Land Consultants, Inc. is a Florida land-development company that developed and sold lots in Hawks Bluff between about 2004 and 2008. The company and the individuals, Rocco Toscano, Joseph Mazzucco, James Vincent, and James Tague, made misrepresentations to consumers related to the roads in the development, in violation of the Interstate Land Sales Full Disclosure Act (ILSA). Among other things, they misrepresented in marketing materials and Housing and Urban Development-registered Property Reports that they would maintain the roads until they were accepted by Van Buren County, Tennessee. In fact, the roads have not been maintained, and have not been accepted by the county.

The company and individuals have admitted liability for their conduct. Under the terms of today’s order, they will be required to repair certain roads in the development to the CFPB’s satisfaction and consistent with an engineering report to be prepared by an independent consultant.
